A North Dakota landlord has 30 days after the tenancy ends to return a security deposit or send a written list of what was kept.

Deadline
30 days
What the landlord must send
The landlord must itemize any part kept and deliver or mail it, with the amount due and a written notice, within 30 days.
If the landlord gets it wrong
A landlord is liable for three times any deposit money withheld without reasonable justification.
Deposit limit
1 month’s rent (up to 2 months in limited cases)
Interest
The deposit must be held in an interest-bearing account; interest is owed if the tenant stayed 9 months or more.

A separate pet deposit is allowed, up to $2,500 or 2 months’ rent, whichever is greater.

The law

N.D. Cent. Code § 47-16-07.1. Read the statute.

Checked against the statute in October 2026. Laws change, so confirm the current rule before you rely on it.

What to do next

If the deadline has passed, or the landlord kept money without a proper list, put your request in writing. Ask for the deposit back by a specific date, and keep a copy. The free first letter in the Deposit Demand Letters kit does this for North Dakota, and the deadline calculator works out your exact date from your move-out day.
