Security deposit return deadline in Idaho
An Idaho landlord has 21 days after the tenancy ends to return a security deposit, or up to 30 days if you agreed to that in writing.
- Deadline
- 21 days (up to 30 if agreed in writing)
- What the landlord must send
- A partial refund must come with a signed statement itemizing amounts kept, their purpose, and a detailed list of expenditures.
- If the landlord gets it wrong
- The statute sets no multiple; the tenant can sue for the amount wrongfully kept.
A landlord may not keep any of the deposit for normal wear and tear.
The law
Idaho Code § 6-321. Read the statute.
Checked against the statute in October 2026. Laws change, so confirm the current rule before you rely on it.
