Security deposit return deadline in Mississippi
A Mississippi landlord has 45 days after the tenancy ends to return a security deposit or send a written list of what was kept.
- Deadline
- 45 days
- What the landlord must send
- Any amount claimed must be itemized in a written notice sent with the remainder.
- If the landlord gets it wrong
- Keeping the deposit without good faith can add damages up to $200 plus actual damages.
The 45 days run from the end of the tenancy, delivery of possession and the tenant’s demand.
The law
Miss. Code § 89-8-21. Read the statute.
Checked in October 2026 against a published copy of the statute, because the official code site was unavailable. Laws change, so confirm the current rule before you rely on it.
What to do next
If the deadline has passed, or the landlord kept money without a proper list, put your request in writing. Ask for the deposit back by a specific date, and keep a copy.
