Why even small websites need legal pages now

A decade ago, legal pages were big-company theater. Now three forces make them table stakes for everyone: privacy statutes (Europe's GDPR and a growing roster of US state laws) define "personal data" broadly enough to cover analytics and email forms; the services you depend on — Stripe, PayPal, Google AdSense, Meta ads, app stores, email platforms — contractually require a posted privacy policy; and courts enforce well-posted terms that limit liability, protect your content, and set dispute ground rules.   1. The privacy policy says what's true. What you collect (analytics, cookies, form data, accounts, payment info — processed by your payment provider, not stored by you), why, who touches it (processors like your email and analytics tools), how long, and how people can reach you about it. Accuracy is the whole game — a policy that overpromises is worse than none.
  2. The terms set the rules. Your content is yours; user misuse is prohibited; the service is provided as-is with liability capped; disputes have a venue. For stores: order, pricing-error, and shipping terms. For SaaS: accounts, termination, and subscription terms.
  3. The refund policy prevents chargebacks. A clear, findable refund policy is your first chargeback defense — card networks check whether the policy was disclosed before purchase.

Do GDPR and the state privacy laws actually apply to me?

Formally, most US state privacy laws kick in at volume thresholds (commonly 35,000–100,000+ residents' data per year) that small sites don't hit, and GDPR applies when you target or monitor people in Europe. But practically, the honest-disclosure baseline is the same everywhere, your vendors require it regardless, and writing the policy to that baseline means you don't rewrite it as you grow. The one rule that outranks all pages: never say anything in a policy that isn't true. The FTC's enforcement sweet spot is not small sites without policies — it's sites whose policies lie ("we never share your data" atop a site running ad trackers).
